Information concerning the processing of personal data

In accordance with Articles 13 and 14 of the European Regulation 2016/679-GDPR, concerning the protection of individuals with regard to the processing of Personal Data, as well as the Italian Legislative Decree no. 196/2003 concerning the Personal Data Protection Code, subsequently modified and supplemented by Legislative Decree no. 101/2018 in transposition of the GDPR (hereinafter “Privacy Code”)

1. Data Owner
Studio Franco Medical Service informs you that - in relation to the Personal Data you voluntarily provide, in accordance with the provisions of the GDPR, the Italian law and the measures adopted by the Italian Data Protection Authority - we will process your Personal Data (Hereinafter “Data”) only for the purposes of establishing and managing the current relationship and responding to your request for information.

2. Processing Source and Object
The Data processed are: name, surname, date of birth, sex, contact information such as telephone number and e-mail address.
The above Data will be processed to answer your requests and for all related activities, including the purposes of establishing and managing contractual relationships of any type.
Your Data are acquired and processed by the Owner, in compliance with the GDPR and the Privacy Code.
We remind you of the need to promptly notify the Owner of any changes to the above Data in order to provide for timely updating or cancellation.

3. Purpose and Method of Processing
The Data collection and other processing operations are carried out by the Data Owner for the following purposes:
a) correct management of the request for information and fulfilment of the request;
b) performance of any professional assignment received;
c) compliance with legal obligations;
d) sending of information material.
The Data will be handled in a lawful manner, according to correctness and with the utmost confidentiality, mainly through electronic and digital instruments and saved on digital or paper supports or on any other suitable support, in accordance with the appropriate security measures as provided by Privacy Code.
The Data processing is carried out by means of the operations indicated in art. 4 no. 2) GDPR: collection, registration, organization, conservation, consultation, processing, modification, selection, extraction, comparison, use, linking, block, communication, cancellation, and destruction of Data.

4. Processing Duration Period and Storage
The Owner will process the Data for not more than 2 years after the last contact in case of request for information, unless the longer storage is legally permitted for other reasons; no more than 10 years from the conclusion of the contract in case of establishment of a professional relationship, until the revocation of consent in case of authorization to send information material.
The Data will subsequently be deleted, without undue delay, once such retention time has elapsed.

5. Communication, dissemination and transfer abroad.
The employees and collaborators, even external, of the Owner and of the Manager and the subjects who provide instrumental services for the above-mentioned purposes (such as, for example, technical services for the management of IT systems) may be made aware of your Personal Data. Such subjects shall act as Data Processors or Persons in Charge of the Processing. The Data may be communicated to third parties, who provide functions related to the service you requested.
The Owner may report your Personal Data to Supervisory Bodies and Legal Authorities as well as any entities they are legally required to disclose information for the pursuit of stated purposes.
The above-mentioned Data will not be disseminated.
Data management and conservation will take place within the European Union on servers of the Owner and/or third parties companies duly appointed as Data Processors.
The Data will not be transferred outside the European Union. Anyway, it is understood that the Owner, if necessary, will be able to move the location of the servers to other EU and/or non-EU countries. In such a case, the Owner hereby guarantees that transfers of Data outside the EU will be done in accordance with the applicable laws.

6. Legal Basis of the Processing
The legal basis of Data processing is the consent given directly by you.

7. Provision nature, consequences of the refusal and legal basis of the processing
In relation to the purpose sub 3, the provision of your Personal Data is optional, however the refusal to supply could mean that we would be unable to deal with your request for information and/or send you informative material.

8. Rights of the Data Subject
In relation to Data processing, according to articles 15-22 of the GDPR, you are entitled to exercise the following rights:
– Right to access, rectify and integrate your own Data;
– Right to erasure ( “Right to Be Forgotten”);
– Right to limit the processing and right to object to the processing;
– Right to Data portability;
– Right to be not subjected to a decision, including profiling, based solely on automated processing;
– Right to complain to the Data Protection Authority.
